Quest App - Privacy Notice 

    This Privacy Notice applies to the use of Deliverect Quest App (“App”). The App is controlled by Deliverect NV or any of its affiliates ("Deliverect", "our", "we" or "us").  We process personal data collected from the App and/or from the mobile device where you download the App.  

    The App helps you efficiently pick and prepare orders received by the retail stores that we provide our technology services to (“Store”). The App is made available to you by us at Store’s request.

    In order for Deliverect to provide the App to you and to make sure it functions properly, we use some of your personal data. We take your privacy seriously and would like to inform you, via this Privacy Notice, about what personal data is processed within the App, how we process this personal data, and the purposes of this processing.

    1. What personal data is processed?

    To provide you with access to the App and its features, we collect the following personal information from you:

    1. User profile information. Your name, surname, and email address; You initially share your personal data with the Store, which manages your account creation process. In the future, the accounts may be created directly through the App without the Store’s involvement. 

    2. Performance Information. The app may track metrics related to picking efficiency and accuracy, which can be accessed by the Store. This includes data on how quickly and accurately orders are processed, allowing the Store to assess staff performance and operational efficiency. This information is not used to identify or profile you beyond the scope of order management. 

    2. What do we use your personal data for?

    We use your personal data for the following purposes:

    1. Registration and Login. To limit the access and to improve the security of the App we ask you to login to the App with your email address and password. The legal ground for the processing of this data is the performance of the service we provide via the App.

    2. Delivery and App improvements. We use your data to enable you to fulfill pickup services to the Store, analyze how you use the App, develop new products and services, and improve functionality, quality, and user experience. This includes using aggregated, anonymized data to improve the App.

    3. Communicating with you. We may contact you to send important notices via push and in-app notifications. This includes, for example, order status, order assignment, order prioritization, and updates about the App, and new features. See “Your Choices” below to learn how to manage your communication preferences.

    4. Providing customer support. We use your personal and App usage information to respond to Store or support requests. We may also use your data to support issues that may arise through your use of the App. 

    5. Data storage. We store your personal and App-related data on servers hosted by Google Cloud. We use appropriate technical, administrative, and physical measures to secure your data during storage.

    6. Legal proceedings and requirements. We use data to investigate or address claims or disputes relating to the use of our services and the App, to satisfy requirements under applicable laws, regulations, or operating licenses or agreements, or pursuant to legal process or governmental request, including from law enforcement. We perform the above activities on the grounds that they are necessary for purposes of our legitimate interests in investigating and responding to claims and disputes relating to the use of our services and features, and/or necessary for compliance with applicable legal requirements.

    3. With whom is personal data shared?

    We may share your information with the following third parties for limited purposes:

    1. Store as they create your account and share the credentials of your account with you;

    2. Other members of our group for administration or reporting purposes;

    3. Processors/ or controllers who act as subcontractors for us in providing our services and running the App;

    Occasionally, we may need to disclose your personal information to third parties where necessary for the legitimate interests of our business or in order to comply with legal obligations, for example:

    • In the event that we sell or buy any business or assets, in which case we may disclose your personal information to the prospective seller or buyer of such business or assets;

    • If we have to disclose or share your personal information in order to comply with any legal obligation or request from a regulator or governmental agency, or to detect or prevent fraud or crime;

    • With our professional advisers and contractors, including lawyers, bankers, auditors and insurers who provide various services to us; and

    • To enforce or apply our App T&Cs or other agreements, to protect the rights, property or safety of our group, our customers or others, and in connection with legal claims.

    4. Your Choices

    Where appropriate or legally required, we will describe how we use personal information, so you can make choices about how your data is used. You can notify us of your preferences during the information collection process and change your selection at any time by contacting us directly. 

    1. Push notifications. You can opt-out of receiving push notifications through your device settings. Please note that opting-out of receiving push notifications may impact how the App functions, as some of those push notifications will include transactional content that is relevant to the provision of your delivery services.

    2. App information. You can stop us from collecting information through the App by uninstalling the mobile app. You can use the standard uninstall processes available on your mobile device or via the mobile application marketplace or network. You can also directly contact Store to deactivate your account.

    5. Your Rights

    You have certain rights in connection with the personal information we obtain about you. To update your preferences, correct your information, limit the communications you receive from us, or submit a request to exercise your rights, please contact us as specified in the “Contact Us” section. 

    As required by law, you have the right to: 

    1. Request access to certain personal information we maintain about you;

    2. Request that we update, correct, amend, erase or restrict certain personal information;

    3. File a complaint with a relevant Data Protection Authority; and

    4. Exercise your right to data portability.

    In some circumstances you can withdraw consent you previously provided to us or object to the processing of your personal information, and we will apply your preferences moving forward. 

    To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to the information. We may also decline your access request, but in the event we do, we will provide an explanation for our decision. Your request and choices may be limited in certain cases: for example, if fulfilling your request would reveal information about another person, or if you ask to delete information which we or your administrator are permitted by law or have compelling legitimate interests to keep. 


    6. How Long We Retain Information 

    How long we keep information we collect about you depends on the type of information, as described below. We will either delete or anonymize your information or, if this is not possible (for example, the information is stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible.

    1. Account information. We retain user profile and transaction information for as long as you maintain your App account. We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations, and to continue to develop and improve our services and the App. Where we retain information for the improvement and development of the App, we take steps to eliminate information that directly identifies you. 

    2. Deleting information. We retain performance, device, and usage data for as long as necessary to provide services based on the instructions of the Store and comply with applicable laws. For example, we retain such data for regulatory, tax, insurance, litigation, and other legal requirements. We may also use such information for purposes of safety, account security, fraud prevention and detection, and research and development during this retention period.

    7. Security Safeguards 

    We use reasonable and appropriate physical, technical, and administrative safeguards, aligned with industry best practices, to protect your information from unauthorized use, access, loss, misuse, alteration, or destruction. We also require that third party service providers acting on our behalf or with whom we share your information also provide appropriate security measures in accordance with industry standards. Notwithstanding our security safeguards, it is impossible to guarantee absolute security in all situations.     8. Changes to this Privacy Notice 

    We periodically update this Privacy Notice to describe new features, products, or services, and how those changes affect our use of your information. We encourage you to review this Notice for updates each time you use the App.
