User Privacy Notice
Thank you for engaging with Deliverect N.V., a company incorporated under the laws of Belgium, with company number 0692.623.253, with a registered office at Foreestelaan 82, 9000 Ghent, Belgium ("Deliverect", "our", "we" or "us”), and for accepting our terms and conditions (“Terms”) to create and use your centralized Deliverect account (“Deliverect Account”). This Privacy Notice applies to all personal data collected from you in the performance of the Terms and to create, operate, and use the Deliverect Account (“personal data”), and it explains what the Deliverect Account is for, and how we use the personal data.
1. What personal data do we collect?
Identification. Your name and full surname, email address and date of birth (optional).
Address information. To create your Deliverect Account you will be promoted to point the delivery address on the map.
Username. To create your Deliverect Account you will be promoted to select a username. Username can be your email address or phone number.
Phone Number. We will send you an SMS, to the phone number that you provided for the creation of the Deliverect Account, to authenticate your identity. Your Deliverect Account will not be created and/or activated until the authentication process has been successfully completed.
2. What do we use your personal data for?
We use your personal data for the following purposes:
Account creation, authentication and login. The purpose of the Deliverect Account is to simplify the process of ordering products from Deliverect Customers, in the sense that you only need to have one Deliverect Account, instead of having independent accounts with each Deliverect Customer. When you create a Deliverect Account, our servers record and centralize personal data and it will automatically be used for your order from other Deliverect customers that use Deliverect Social Ordering. The legal ground to process your personal data for this processing activity is the performance of the Terms.
Product improvements. We use your data to improve functionality, quality, and user experience. The legal grounds to process your personal data for this processing activity is our legitimate interest. Legal proceedings and requirements. We use your data to investigate or address legal claims or disputes relating to use of Deliverect Account, to satisfy requirements under applicable laws, regulations, or operating licenses or agreements, or pursuant to legal process or governmental request, including from law enforcement. We perform the above activities on the grounds that they are necessary for purposes of our legitimate interests in investigating and responding to claims and disputes relating to use of our services and features, and/or necessary for compliance with applicable legal requirements.
3. With whom is personal data shared?
We may share your information with the following third parties for limited purposes:
Deliverect customer using Deliverect Social Ordering, for the performance of the contract between Deliverect and its customer, and between you and the Deliverect customer. Your Data would be processed by our customer for CRM & loyalty and marketing purposes. Within the scope of this processing activity, we process Your Data under the instructions of the Deliverect customer as the processor of Deliverect customer. Deliverect Customer is the sole responsible party to take your consent as a controller, if required.
Other members of our Deliverect group for administration or reporting purposes.
Technology service providers. We may also collect information whenever you use your Deliverect Account to improve the usability and functionality of our services. Such information may be collected through third party services such as Mixpanel, Meta Pixel and Google GTM.
Occasionally, we may need to disclose your personal information to third parties where necessary for the legitimate interests of our business, or in order to comply with legal obligations, for example:
In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets;
If we have to disclose or share your personal data in order to comply with any legal obligation or request from a regulator or governmental agency, or to detect or prevent fraud or crime;
with our professional advisers, including lawyers, bankers, auditors and insurers who provide various services to us; and
To enforce or apply our Terms or other agreements, to protect the rights, property or safety of our group, our customers or others, and in connection with legal claims.
Due to the nature of the business, your personal data may be transferred to or accessed by Deliverect group companies or technology service providers located outside the European Economic Area. When we do so, we ensure to comply with laws on the transfer of personal data between countries.
4. Cookies and other tracking technologies
Cookies are very small text documents, which often include an anonymous unique identifier. We use cookies and similar technologies on the online channel that you access to use Deliverect Social Ordering (“online channel”) for purposes such as:
Authenticating users
Remembering user preferences and settings
Analyzing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with our services
We may use the following cookies:
Strictly necessary cookies help make a website usable by enabling basic functions like page navigation and access to secure areas of the website. The website cannot function properly without these cookies. Strictly necessary cookies are always active.
Functional cookies enable the online channel to provide enhanced functionality and personalisation. They may be set by us or by third party providers whose services we have added to our pages. If you do not allow these cookies then some or all of these services may not function properly.
Analytical cookies. These cookies allow us to collect information about how visitors use the online channel, for example to count visitors and to see how visitors move around the online channel. They record your visit to the online channel, the pages you have visited and the links you have followed. This helps us to improve the way the online channel works.
Mixpanel. We use Mixpanel technology to perform statistical evaluations. This allows us to improve and optimize product features, measure behaviors, better understand how you interact with Deliverect Social Ordering and make it more appealing. Google Tag Manager. We use the tool Google Tag Manager by Google on the online channel. The tool Tag Manager itself (that implements the tags) is a cookie-free domain. Through this service, website tags can be triggered, which allow us to draw conclusions about the use of the online channel that you use for Deliverect Social Ordering. The Google Tag Manager still triggers tags from other providers, which in turn may collect data. However, the Google Tag Manager does not access this data. If IP tracking has been deactivated, it remains in place for all tracking tags, provided they are implemented with the Google Tag Manager. Meta Pixel. We use the Meta pixel on the online channel. Meta pixel can be used to track your behaviour after you have clicked on a Meta ad or visited our website and a cookie has been stored on their device with the help of the pixel. Meta pixels are small pieces of software and are nearly invisible pixel-sized “dots” on the online channel which create a link between your visit to the online channel and Meta. When the pixel loads, Meta places a so-called “fr”-cookie on your device, which helps Meta to provide you with more personalized advertisements, but also to measure and improve advertisements. Please note that when the “fr”-cookie is placed, Meta is able to follow your surfing behavior across other websites which have implemented a Meta pixel or Meta social plug-in.
5. Your Rights
You have certain rights in connection with the personal data we obtain about you. To update your preferences, correct your information, limit the communications you receive from us, or submit a request to exercise your rights, please contact us as specified in the “Contact Us” section.
As required by law, you have the right to:
Request access to certain personal data we maintain and process about you;
Request that we update, rectify, correct, amend, erase or restrict certain personal data;
Object to the processing of your personal data;
File a complaint with a relevant Data Protection Authority; and
Exercise your right to data portability.
To help protect your privacy and maintain security, we may take steps to verify your identity before granting you access to personal data. We may also decline your access request, but in the event we do, we will provide an explanation for our decision. Your request and choices may be limited in certain cases: for example, if fulfilling your request would reveal information about another person, or if you ask to delete information which we or your administrator are permitted by law or have compelling legitimate interests to keep.
6. How Long We Retain Information
The retention period of your personal data depends on the type of information, as described below. We will either delete or anonymize your information or, if this is not possible (for example, the information is stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible.
We retain user profile and related information for as long as you maintain your Deliverect Account. We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations, to defend legal claims, and to continue to develop and improve our services and products.
7. Security Safeguards
We use reasonable and appropriate physical, technical, and administrative safeguards, aligned with industry best practices, to protect your information from unauthorized use, access, loss, misuse, alteration, or destruction. We also require that third party service providers acting on our behalf or with whom we share your information also provide appropriate security measures in accordance with industry standards. Notwithstanding our security safeguards, it is impossible to guarantee absolute security in all situations. We periodically update this Privacy Notice to describe new features, products, or services, and how those changes affect our use of your information.
